Scott County District Court report

The following are Scott County District Court felony and gross-misdemeanor dispositions. Defendants either pleaded guilty or were found guilty by the court unless otherwise indicated.

Antonio Martinez Anastacio, 30, Savage, driving while intoxicated (refusal to submit to test), a gross-misdemeanor. Two years’ probation, $405 in fines.

Michael Andrew Dassrath, 20, Shakopee, fifth-degree possession of controlled substance, a felony. Five years’ probation before conviction: 20 days of electronic home-monitoring, restitution, $500 in fines. DWI, a gross-misdemeanor. Four years’ probation, 30 days in jail, 60 days under electronic home-monitoring (consecutive to previous sentence), abstain from alcohol, random tests, $105 in fines.

Mark Christian Hartman, 24, Fort Erwin, Calif., DWI, a gross-misdemeanor. Two years’ probation, $605 in fines.

James Anthony Hill, 36, Chatsworth, Calif., DWI, a gross-misdemeanor. Two years’ probation, five days in jail, 25 days under electronic home-monitoring, $405 in fines.

Scott Richard Macallister, 41, Shakopee, DWI, and violation of driver restrictions, both gross-misdemeanors. Two years’ probation, 180 days in jail, abstain from alcohol, random tests, $980 in fines.

Douglas Scott Schmeidel, 50, Eden Prairie, DWI, a gross-misdemeanor. Two years’ probation, three days in jail, 45 days under electronic home-monitoring, abstain from alcohol, random tests, $825 in fines.

Daniel Joseph Thiede, 40, Burnsville, DWI, a gross-misdemeanor, and driving after suspension, a misdemeanor. Two years’ probation, 35 days in jail, 60 days under electronic home-monitoring, abstain from alcohol, random tests, $1,005 in fines.

Michelle Lee Walgenbach, 42, Shakopee, obstruction of the legal process, a gross-misdemeanor. Two years’ probation, 10 days in jail, abstain from alcohol, random tests, evaluation, $80 in fines.
Thomas James Wilson, 47, Shakopee, fifth-degree possession of controlled substance, a felony. Five years’ probation before conviction: Four days in jail, random tests, $600 in fines.

Joshua Simon Young, 20, Shakopee, first-degree burglary, a felony. Ten years’ probation, 180 days in jail, abstain from alcohol, random tests, provide DNA sample, complete treatment, $980 in fines. DWI, a misdemeanor. Serve 90 days (concurrent).

Sarah Christine Wiherski, 25, Minneapolis, wrongfully obtaining assistance (theft), a gross-misdemeanor. Two years’ probation, 10 days under electronic home-monitoring, restitution, $80 in fines.

Shaun Michael Ergeson, 30, Elko New Market, first-degree burglary, a felony. Five years’ probation, 90 days in jail, provide DNA sample, restitution, $105 in fines. First-degree criminal damage to property, a felony. Five years’ probation, 45 days in jail, restitution, $1,255 in fines. Driving after revocation and failure to notify owner of damaged property, both misdemeanors. Serve 90 days in jail (concurrent with previous sentence).

Michel Robert Bergren, 34, Prior Lake, violation of predatory offender requirements, a felony. Serve year and a day in prison, $80 in fines.

James David Giildenzopf II, 18, Lakeville, fifth-degree possession of controlled substance, a felony. Five years’ probation before conviction, three days in jail, 10 days under electronic home-monitoring, 10 days of community service, abstain from alcohol, random tests, $525 in fines.

Donald Dean Gleason, 60, Carver, driving after cancellation (inimical to public safety), a gross-misdemeanor. Two years’ probation, 30 days in jail, $80 in fines.

Richard Steven Johnson, 38, Veseli, Minn., second-degree assault with a dangerous weapon, a felony. Seven years’ probation, six months in jail, provide DNA sample, anger-management counseling, restitution, $1,756 in fines. Reckless driving, a misdemeanor. Serve 90 days in jail (concurrent).

Robert Christopher Kendrick, 22, Eden Prairie, third-degree burglary, a felony. Five years’ probation, 120 days in jail, restitution, provide DNA sample, $80 in fines.

Christopher James O’Regan, 18, Shakopee, theft, a felony. Adjudication stayed: Five years’ probation, 30 days of community service, restitution, $700 in fines.

Ashley Kay Tuckner, 23, Belle Plaine, wrongfully obtaining assistance (theft), a felony. Two years’ probation, 80 hours of community service, restitution, $180 in fines.

Dale Mark Lambrecht Jr., 29, Hartland, Minn., DWI, a gross-misdemeanor. Two years’ probation, two days in jail, 28 days under electronic home-monitoring, abstain from alcohol, random tests, $280 in fines.

Amy Jo Nemitz, 22, Audubon, Iowa, issuance of dishonored check, a gross-misdemeanor. Two years’ probation, 90 days in jail (concurrent with previous sentence), restitution, $998.32 in fines.

Anthony Dean Brissett, 20, Shakopee, third-degree burglary, a felony. Five years’ probation, one year in jail (concurrent to previous sentence), five days of community service, no contact with victim(s), provide DNA sample, abstain from alcohol, random tests, restitution, $80 in fines. Third-degree criminal damage to property, a gross-misdemeanor. Two years’ probation, 90 days in jail (concurrent).

Eric Mathew Swanson, 40, Jordan, fifth-degree possession of controlled substance, a felony. Five years’ probation, 30 days in jail, 28 days of community service, provide DNA sample, $605 in fines.

Danny Tarry Dye, 39, Belle Plaine, fifth-degree possession of controlled substance, a felony. Three years’ probation before conviction: Abstain from alcohol, evaluation, $425 in fines.

Kevin Edward Cyr, 43, Woodbury, fifth-degree possession of controlled substance, a felony. Five years’ probation, six months in jail, abstain from alcohol, random tests, provide DNA sample, restitution, $105 in fines. Receiving stolen property, a misdemeanor. No additional sentence.

Bernard Joseph Kane, 52, Morristown, Minn., second-degree burglary, a felony. Ten years’ probation, 30 days in jail, provide DNA sample, undergo therapy, restitution, $500 in fines.

Daniel Antonio Rodriguez, 29, Bloomington, DWI, a gross-misdemeanor. Two years’ probation, two days in jail, 28 days under electronic home-monitoring, abstain from alcohol, random tests, restitution, $580 in fines.
