Fired officer faces charges; Pudwill's lawyer responds

Brady Silver reports: The Scott County Attorney's Office has filed a criminal complaint against Jordan's 2006 police officer of the year, Corey Pudwill, who the city council fired last fall. Pudwill, a Belle Plaine resident, is charged with one count of fourth-degree and one count of fifth-degree criminal sex conduct for initiating "nonconsensual sexual contact during a traffic stop," according to a press release from the Jordan Police Department. The fourth-degree charge relates to an allegation of coersion, while the fifth-degree charge allegedly involves sex misconduct without the removal of clothing. Pudwill “categorically denies the allegation,” Paul Engh, Pudwill’s attorney for the criminal case, told the Jordan Independent in a statement and during a phone interview this week. According to the complaint filed in Scott County, this is what happened: At 4 a.m. Aug. 20, a 19-year-old woman was leaving Mystic Lake Casino. She was headed towards her home in Le Sueur and had turned from a back road onto Highway 169 when a police car stopped her. The officer, Pudwill, told her the muffler on her car was sparking, she alleged. The woman did not have a driver's license, only a valid instruction permit. Pudwill asked the woman if she'd been drinking, issued a breath test, searched her, and moved her into the backseat of the squad car, according to the complaint. Pudwill told the woman her car would be towed and she would get a ticket for driving without a license, the complaint said. He told her it would cost about $450 and asked if she could afford it, she alleged. When she said she couldn't, he responded, "Well, what can we do about it?" she alleged. She said she didn't know, according to the complaint. They were pulled far over on the side of the road, the woman said. Pudwill asked her if she wanted to go somewhere for a few minutes before she headed home, the woman alleged. She didn't answer that question. She instead asked if he was taking her to jail, according to the complaint. Pudwill then repeated that he needed to know what she thought they could do if she couldn't afford the cost of the tow and ticket, the woman said. Then, Pudwill touched the bra under her sweater, the woman alleged. The woman then pulled her shirt down and asked the officer to give her a citation and take her to jail, according to the complaint. Pudwill released the woman without a citation and allegedly told her she should get a driver's license and pretend that he never pulled her over, the woman told police. After the incident, the woman immediately drove to her ex-boyfriend's house in Le Sueur. She told him and his sister what Pudwill allegedly did. She reported the alleged incident to the Le Sueur and Jordan police departments. "If true, the officer's conduct is inexcusable and can only be described as a serious breach of public trust," Police Chief Bob Malz said about Pudwill. Investigators learned that the video camera in Pudwill's police car had either not been activated or that the incident had been deleted after recording. According to the complaint, Pudwill told the investigators that he had been having problems with the camera. Engh, Pudwill’s attorney, said that his client told investigators that the camera itself was on but that the incident in question was not recorded because the tape was already completely full. The lawyer said this week that the tapes in Jordan squad cars’ cameras routinely fill up. “We’re saying that happened a lot,” Engh said. Pudwill was able to make and keep the video recordings of each of his next four traffic stops, which occurred after his encounter with the woman on the same date, according to the complaint. Engh also pointed out, the camera would not have filmed the backseat of the squad car, where the incident allegedly occurred. In Jordan's press release, Malz declined to speculate on the guilt or innocence of Pudwill and said that the officer is entitled to due process in the courts. Pudwill has made thousands of stops and arrests without incident and has won commendations and awards for his work. His “exemplary record” calls into question the allegations, Engh said. The court complaint omits reference to the fact that Pudwill provided a detailed statement to law enforcement officials, denying the conduct alleged, Engh said. Pudwill failed Shakopee’s lie detector test, Engh said, but he passed an independent lie detector test. The test results were sent to the Shakopee Police Department, Engh said. After the alleged incident, the Jordan police referred the victim's complaint to the Shakopee police to avoid any potential conflict of interest. Pudwill was notified he would be on paid administrative leave while Shakopee police conducted an internal investigation. The complaint against Pudwill was filed in Scott County, but Carver County is prosecuting him. He is scheduled to appear in district court this month. The city council fired Pudwill after a closed meeting in October. City officials said he violated city policy related to a complaint filed against him, but they wouldn't comment on the details or announce the name of the employee it terminated, citing a data privacy law that protects information about employee disciplinary actions. Pudwill filed an arbitration case that is ongoing. There has been no progress in the arbitration case, City Administrator Ed Shukle said. Mary Lee Abrams, his union lawyer, did not immediately return recent phone calls seeking comment and has previously declined to comment on the case. Pudwill started working for the Jordan police in April 2003 and has been reprimanded before. In 2004, Pudwill was given a three-day suspension by the Jordan police for executing an arrest warrant outside of legal hours. He then tried to hide his actions from the police department administration, according to the press release. Pudwill has received numerous other awards in his career. He received a National Highway Traffic Safety Achievement Award in June 2005 and three certificates of commendation for outstanding service. Back to page topO.k., so I wasn't going to make anymore comments on these stories, but I just have to submit one tiny comment. This one regarding the writer. You didn't even get Mr. Pudwill's lawyer's statement correct. I believe what Mr. Engh said one of the lie detector tests was found "inconclusive and biased", that does not mean that he failed. I believe you used the word "failed" based on your own assumption and that is irresponsible writing. "Inconclusive and biased" means that the lie detector administrator was biased because of reading the complaint before hand. something that should not happen when lie detector tests are administrated.

Officer Pudwill, happily married and the father of five children, has made thousands of stops and arrests during his work for the Jordan Police Department, each without incident. He has received numerous commendations and awards for his work. Given Officer Pudwill's exemplary record, the presumption of innocence along calls into question the allegations made.
"Secondly, the complaint omits reference to the fact that Officer Pudwill provided a detailed statement to law enforcement officials, denying the conduct alleged. He submitted to an independent lie detector test and passed.
"And third, concerning the camera in the squad car, Office Pudwill told investigators that the camera itself was on, but that the arrest in question was not recorded because the tape was already completely full."

Back to page topI honestly think there is misrepresentation or at the very least some irresponsible, inconclusive and down right bad reporting going on around here.
For example, why was the story released on a Friday afternoon? You state the union lawyer did not "immediately return the phone call", what chance would there have been for that on a Friday afternoon? Furthermore, why was Paul Engh, his defense attorney, who is known to Jordan, Shakopee, and Carver County officials, not contacted? It seems there was no attempt to get the other side of this story.
You show us the email quotes yourself. I don't see "failed"
stated anywhere. And at this point, even though I know you and Brady are Reporter and Editor, I really cannot take your word that the information is accurate. Every reader that reads anything in print should question what they are reading.
Here's the deal, let's take the whole issue of this accusation and the officer and put it aside for one second. In my opinion, there is clearly a bad investigation along with bad reporting going on here.
Now this is only my opinion and I know it doesn't count for much, but it sickens me that small town biased papers get away with innacurate, gossip like reporting. Don't worry, I am not accussing your Jordan Independent as being the sole paper in doing so. I read papers from all over small towns and it seems that it is a norm. It truly is very sad that this happens because there are too many people out there that read these papers and rather than questioning information, reporting, and stories, they read or follow along and mindlessly think that the information that they are reading is absolutely correct.
My whole point in any of the comments I make, besides supporting Corey, is to let people know that they need to look closely at what is being reported and what might really be the facts. People can't take reporters (or investigators that have been called in by their own small town officials) and necessarily take any of their words as an absolute.

Are we supposed to just believe the word of this unknown woman over our officer of the year? What ever happened to 'innocent until proven guilty'? Does this not apply to police officers? Why is it okay for a man's name, who we have trusted to keep our streets safe for three years, to be dragged through the mud, while we know virtually nothing about this woman? What about her background? What kind of person is she?
We know kind of man Corey Pudwill is. I'm thinking the Officer of the Year award isn't just handed to out to any old cop.

Back to page topThank goodness you had the nerve to write in and back up your officer. You are absolutely correct about not knowing the facts. Why would he pull her over on a major hwy if this is what he had in mind? Does anyone tell you that he called in her plates? Why would he do that? If I were a policeman I wouldn't leave any tracks like that. But he did call her plates in, obviously he didn't have any such intent to do what she has accused him of. He wrote out the most tickets (never popular if your one of them getting written up) but also never had any accusations after all those he had stopped. When I first learned of the policeman being fired, didn't I read there was nothing criminal about his dismissal? Guess I wouldn't want to work where there is no support system. All you have to do is say "he did this to me".. How sad!

Back to page topIs it just me, or is this whole situation a rerun of a really bad cop show? I have to be honest, I'm very disappointed in the lack of support for Officer Pudwill. Everyone was willing to speak up and stand behind him when he was getting all those awards for the last three years. There has been a valid point. Fired after one complaint, of how many thousands of tickets? I hate to beat a dead horse, but we know nothing about this woman, and we are supposed to believe her just because she says it happened? Gimme a break!!!

Back to page topI totally agree with the lack of support that is being shown by the PD and city officials. However, I do personally think that Officer Pudwill has much more support than what is being shown on this website. I know there are many citizens in the Jordan community, as well as other communities that support him. They just don't necessarily put it in writing. Hopefully more people will come forward and show their support in writing. I would like to point out that more people might be commenting and showing support on this site than we know about. I know that I wrote two comments when the article first ran that got yanked. Mathias did call me and say that I could support Corey and make positive comments, but that the comments that I was trying to post needed some editing. I suppose due to the fact that I too questioned the the 19 year olds motives. Throughout my postings I have also questioned how the investigation is being handled in general. If I were a Jordan citizen, I would be wondering why they waited so long to press charges? It seems to me that the charges came about when this case went into arbitration. Were city officials worried that they were wrong in firing Corey? Did it look like he was going to be getting his job back and back pay was going to come about and now they have to make a stand or they will look bad?

I don't personally know Officer Pudwill but I know that some false accusations about child sexual abuse were made in Jordan in 1984. In fact I wrote a book about the mess. The book "Nightmares and Secrets: The Real Story of the 1984 Child Sexual Abuse Scandal in Jordan, Minnesota" reveals how destructive false accusations can be to an entire community.
I hope these charges are not another nightnmare for my hometown. I encourage our JI to investigate and report the truth so we are not again haunted by sinister secrets.
